越南樓盤: 如何分辨買賣合約(SPA)與長期租約(LTL)?

2019年越南樓盤持續火熱,想到越南投資樓市,卻又不清楚越南住房法規,以及該注意什麼樣的風險?過去兩年來外國人到越南投資樓盤時,常常忽略了隱藏的風險,特別是與開發商簽署合約時,有幾種差別,不同種合約,房產價值也會有所差異,如果仲介不特別說明,就會導致投資者買到不適合自己的產品,以下以賽亞房屋為各位分析 在越南購買房產簽署合約時,您通常有兩種選擇 買賣合約(SPA) 長期租約LTL(Long Term Lease)  通常SPA是外國投資者首選的合同形式,這是因為投資者希望有一份具體的法律文件,證明他們是用本人姓名直接持有該房產,而不是開發商(除了土地,土地在越南不屬於個人,它屬於政府)。 SPA為投資者獲得此財產的責任和權利。   長期租約在政府認定中屬於開發商對投資者的合約,投資者與開發商簽訂了直接合同協議,並享有與SPA合同相同的權利。換句話說,一旦投資者與開發商達成協議,客戶將法律責任和義務交給開發商,而不是自己在法理上直接持有該房產。   外國人在公寓單位的配額為30%,別墅項目為10%,這適用於所有SPA合約。但由於越南房產案源有限,特別是胡志明,有了解的都知道房源緊張、供不應求,因此越南房產價格上漲也是理所當然的事情,並且能夠簽署SPA合同的項目越來越少。   在投資很多項目的時候,簽署SPA會需要注意很多細節,許多越南開發商在還未取得開發執照時,就開始進行銷售,收取ㄧ定金額後,只簽訂訂金合約,與政府的法律文件就慢慢進行,這就導致了SPA簽約延遲。   當投資者以長期租約的方式購買房產時,對於開發商來說比較方便,銷售也不受外國人限額限制,銷售也會較快,但同時投資者也要考量到未來的流通性。   一定要記得的是,當您購買越南房產的時候,簽署長期租約合同的區別是您將直接與開發商而不是政府打交道。因此我們建議簽署長期租約合同的前提是確保與您對接的是專業負責、值得信賴的銷售人員。 0.0 00 [ Đọc thêm ...]
